Introduction & Acceptance

Welcome to Betterhalf, a matchmaking platform. This Agreement sets out the legally binding terms for your use of the Site and membership, and may be modified by Betterhalf from time to time.

Betterhalf is an advertising platform providing targeted advertising services for matchmaking alliances and replaces traditional newspaper classifieds. The Site is for the personal use of individual members to advertise and promote their profiles to find relevant matches.

This Agreement is an electronic contract that establishes the legally binding terms you must accept to use the Site and become a “Member.” “Member” means a person who voluntarily submits information to the Site, whether using the service as a free or paid member. “User” means a person who actively uses the Site to promote his/her profile for matchmaking purposes.

By using the Site, you agree to be bound by these Terms of Use. By registering, you consent to submit personally identifiable information, including sensitive data (e.g., payment details for paid membership, identity proofs if submitted, religion, etc.) so we can collect, process, display, and use it to provide the Service. If you object to this, please do not register.

1. Eligibility

To register or use the Site, you must be legally competent and of legal marriageable age under Sri Lankan law (currently 18 years or over). Membership is void where prohibited.

2. Account Security

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use or breach. Always log out after each session.

3. Term & Termination

  1. This Agreement remains effective while you use the Site.
  2. You may terminate your membership at any time by writing to Betterhalf. Fees paid are non-refundable unless expressly guaranteed in writing.
  3. Betterhalf may terminate your access/membership for any reason (including breach, commercial use, or inappropriate activity) by emailing the address on your account. If terminated for breach, fees are non-refundable.

4. Non-Commercial Use by Members

The Site is for personal use to promote your profile for relevant matches and may not be used for commercial endeavors, including linking to other sites (competitive or otherwise).

5. Other Terms of Use for Members

  1. Betterhalf may review account activity/status and block access at its discretion.
  2. Betterhalf may restrict/suspend free access based on activity/status, with due intimation.
  3. You consent to receive emails, SMS/WhatsApp messages, and calls from Betterhalf and its members while registered, including OTPs for verification and payment gateway transactions.
  4. Multiple profiles for the same person are not allowed; duplicates may be deactivated without refund.
  5. You confirm all information provided is accurate. If creating a profile for another person (e.g., friend/sibling/child), you confirm you have their permission. Impersonation is a crime.
  6. You are strongly advised to submit government ID (e.g., Driving License/Passport) to obtain a verification badge.
  7. Except for promoting your profile for matchmaking, you may not advertise or solicit products/services to members.
  8. No chain letters or junk email to members. Do not use member information to harass, abuse, or solicit without explicit consent.
  9. Betterhalf may take steps to protect the platform and its members from abuse/misuse.
  10. You agree not to use the Services/platforms to harass any member.
  11. Members who subscribe to Betterhalf Select confirm they have read and agree to its specific terms.

6. Proprietary Rights in the Content on Betterhalf

Betterhalf owns and retains all proprietary rights in the Site and Service. The Site contains copyrighted material, trademarks, and other proprietary information of Betterhalf and its licensors. Except content in the public domain or used with permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any proprietary information. Violations may result in termination without refund and may lead to legal action.

7. Content Posted on the Site

  1. Betterhalf may remove any listing/content/communication/photos/profiles (“Content”) that violate this Agreement, are offensive/illegal, or threaten safety.
  2. For Content you submit to publicly accessible areas (including contact details), you grant Betterhalf a license to use, store, reproduce, modify, adapt, distribute, perform, and display such Content on the Site and to the Betterhalf community.
  3. By submitting your success story, you authorize Betterhalf to use and display your photographs and testimony on the Site.
  4. You are solely responsible for Content you upload/post/transmit. Betterhalf does not guarantee accuracy or quality and is not liable for losses from reliance on such Content. Independently verify other members’ information.
  5. Betterhalf may verify the authenticity of Content and request supporting documents. Failure to provide satisfactory evidence may result in termination without refund.
  6. Indicative list of illegal or prohibited Content (actions may include removal and membership termination without refund):
    1. Content promoting racism, bigotry, hatred, or physical harm.
    2. Content that harasses or advocates harassment.
    3. Junk mail, chain letters, or unsolicited mass mailing/spam.
    4. False/misleading information or promotion of illegal, abusive, threatening, obscene, defamatory, or libelous conduct.
    5. Pornographic or sexually explicit material.
    6. Content exploiting persons under 18 or soliciting their personal information.
    7. Instructions for illegal activities (e.g., illegal weapons, privacy violations, computer viruses).
  7. You must use the Service in compliance with all applicable laws, rules, and regulations.
  8. Do not include phone numbers, street addresses, URLs, or email addresses in the member profile visible to others.

8. Your Interaction with Other Members & Member Disputes

You are solely responsible for your communications with other members. Betterhalf may (but is not obligated to) monitor disputes and take appropriate action. Betterhalf is not responsible or liable for transactions or interactions between members.

9. Privacy

Use of the Site and Service is governed by our Privacy Policy. Please follow the guidelines there to protect your privacy.

10. Disclaimers

  1. Betterhalf is not responsible for incorrect/inaccurate listings or Content, whether caused by users/members or systems used by the Service, nor for member conduct online or offline.
  2. No responsibility for errors, omissions, interruptions, deletions, defects, delays, communication failures, theft/destruction, or unauthorized access/alteration of communications.
  3. No responsibility for technical malfunctions (networks, servers, equipment, software, email/players) or congestion causing injury/damage.
  4. Betterhalf is not responsible for any loss/damage resulting from use of the Site/Service or Content posted/transmitted. Do not share financial information with other members.
  5. Exchange of profiles is not a matrimonial offer/recommendation by Betterhalf. Betterhalf is not responsible for outcomes of relationships formed through the Service.
  6. Betterhalf disclaims liability for Content posted by members/users/third parties.
  7. Betterhalf does not assume responsibility for illegal Content posted by members/users/third parties.
  8. Liability for Content rests with the posting member/user/third party. Betterhalf reserves the right to seek damages for harm caused by such Content. Betterhalf does not claim ownership over your Content submitted to the Service.

11. Limitation of Liability

In no event will Betterhalf be liable to you or any third party for indirect, consequential, exemplary, incidental, special, or punitive damages (including lost profits) arising from your use of the Site or Service, even if advised of the possibility. Notwithstanding anything to the contrary, Betterhalf’s total liability to you for any cause, regardless of form of action, is limited to the amount you paid (if any) for the Service during your membership term.

12. Indemnity

You agree to indemnify and hold Betterhalf, its subsidiaries, affiliates, officers, agents, partners, and employees harmless from any loss, liability, claim, or demand (including reasonable attorneys’ fees) made by any third party due to or arising from your use of the Service in violation of this Agreement and/or any breach of your representations, warranties, or fraudulent acts.

13. Jurisdiction

By using the Site, you agree that all disputes shall be governed by the laws of Sri Lanka and are subject to the exclusive jurisdiction of the competent courts in Jaffna, Sri Lanka.

14. Other (Emails)

By becoming a member, you agree to receive specific emails from Betterhalf and/or its group sites. You can unsubscribe at any time by clicking the unsubscribe link in the email.
